Quand il s\u2019agit de nom commercial, il est parfois difficile pour un auto-entrepreneur<\/a> de savoir s\u2019il peut choisir lui-m\u00eame son nom commercial afin de faciliter l\u2019image de son entreprise. Cet \u00e9l\u00e9ment ne doit pas du tout \u00eatre n\u00e9glig\u00e9 afin de se d\u00e9marquer de la concurrence, car en lui-m\u00eame c\u2019est une v\u00e9ritable image de marque.<\/p>\n

Afin de comprendre les d\u00e9marches pour une obtention de nom commercial, il est important de prendre en compte les \u00e9l\u00e9ments suivants afin de ne pas rencontrer de probl\u00e8mes lors de la conception de l\u2019entreprise.<\/p>\n

Le r\u00f4le de l\u2019INPI ou l\u2019Institut National de la Propri\u00e9t\u00e9 Industrielle<\/h2>\n

Il n\u2019est pas tr\u00e8s courant d\u2019entendre cet \u00e9tablissement public qui poss\u00e8de pourtant une tr\u00e8s grande importance dans le domaine industriel, mais aussi dans celui de l\u2019auto-entreprise. En effet, il a pour r\u00f4le d’octroyer des titres de propri\u00e9t\u00e9 industrielle. L\u2019emploi d\u2019un nom commercial ou bien d\u2019un brevet d\u00e9pend uniquement de l\u2019approbation de l\u2019institut.<\/p>\n

Il poss\u00e8de un enregistrement complet de tous les noms et brevets utilis\u00e9s ce qui permet de d\u00e9finir si le nom commercial est d\u00e9j\u00e0 une propri\u00e9t\u00e9 existante ou non. Entre autres, l\u2019institut poss\u00e8de comme r\u00f4le de d\u00e9livrer des informations au public concernant les propri\u00e9t\u00e9s industrielles existantes et enregistr\u00e9es aupr\u00e8s de l\u2019INPI.<\/p>\n

Quelle d\u00e9marche l\u2019auto-entrepreneur doit-il engager ?<\/h2>\n

Afin d\u2019\u00e9viter les probl\u00e8mes au niveau du nom commercial, il est important de prendre en compte certains points au moment de la d\u00e9claration de la conception de l\u2019entreprise<\/a>. Cette d\u00e9claration se fait aupr\u00e8s du Centre de Formalit\u00e9s des Entreprises<\/a> ou plus commun\u00e9ment appel\u00e9 CFE, l\u2019auto-entrepreneur doit remplir un formulaire qui devra contenir toutes les informations de la future entreprise. \u00c0 noter que l\u2019auto-entrepreneur peut choisir une d\u00e9nomination particuli\u00e8re pour faciliter l\u2019identification de son entreprise.<\/p>\n

Le nom commercial sera un moyen de faciliter les \u00e9changes face aux autres entit\u00e9s commerciales. Cette d\u00e9nomination sera utilis\u00e9e sur les cartes de visite, les factures ou biens les papiers commerciaux. La disponibilit\u00e9 de ce nom commercial sera d\u2019abord v\u00e9rifi\u00e9e afin d\u2019\u00e9viter les litiges et ensuite, il sera enregistr\u00e9 aupr\u00e8s de l\u2019INPI et par la suite aupr\u00e8s du Registre national du Commerce et des Soci\u00e9t\u00e9s.<\/p>\n
